1. About This Policy
This Privacy Policy applies to Follett Photography, ABN 91887152216 (“we”, “us”, “our”), including both follettphotography.com.au and earlylearningphotography.com.au. Early Learning Photography is a website used by Follett Photography to make our childcare photography services easier for centre directors to find — it is the same business, and this one policy covers both websites. We are committed to handling personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
Because we offer different types of services — wedding/portrait/commercial photography, and childcare photography — some parts of this policy are separated out below to reflect what’s actually relevant to each.
This policy explains what personal information we collect, how we collect it, why we collect it, how we store and protect it, and how you can access, correct, or ask questions about it.
2. What Personal Information We Collect
The personal information we collect depends on which service you use:
Follett Photography (weddings, portraits, commercial, real estate)
- Name, email address, phone number, and postal/billing address, wedding date, venue ect
- Photographs and images of you, your family, your wedding, or your property
- Order details
- Details you provide about your event, session preferences, or requirements
Early Learning Photography (childcare)
- Childcare centre name
- Child/children’s name(s)
- Child’s class
- Parent/guardian full name, email address, and phone number
- Photographs of children taken at the childcare centre
We do not intentionally collect sensitive information (such as health information) unless you provide it to us voluntarily, for example to let us know about a child’s specific needs during a session.
3. How We Collect Personal Information
We usually collect personal information directly from you or, for childcare sessions, from your childcare centre — for example, through consent forms, our websites, email, phone, or in person during a photography session. Occasionally we may collect information from a childcare centre, but only when you have expressed permission for such.
4. Why We Collect, Hold, Use and Disclose Personal Information
We collect and use personal information to:
- Deliver photography services and produce the images and products you order
- Identify and match images to the correct family or client
- Communicate with you about bookings, sessions, orders, and galleries
- Process payments and fulfil orders through our print and gallery providers
- Where applicable, produce a class photograph for a childcare centre
- Comply with our legal and accounting obligations
We only use personal information for the purpose it was collected for, unless you have separately agreed to another use, or the use is otherwise permitted by law.
5. Direct Marketing
We may send you information about our own services (such as upcoming session availability or promotions) where you would reasonably expect this, or where you have opted in. You can opt out of direct marketing at any time by contacting us using the details below, or via the unsubscribe link in any marketing email.
6. Disclosure to Third Parties
We do not share personal information such as your name, your child’s name, or your childcare centre with printing or fulfilment laboratories, except where a class photograph itself includes a child’s name as printed text within the image — in that case, the name is visible to Brilliant Prints, and on occasions Camera House, only as part of producing that specific product. We only send them the images themselves, for the purpose of printing and delivering your order.
Images may be sent to the following printing and fulfilment providers: Brilliant Prints, Camera House, Seldex, Vistaprint, and Snapfish. Your gallery, including your images, is hosted through ShootProof.
We disclose personal information (such as your name and email address) to trusted third-party service providers who support our business management/invoicing and website hosting, only where necessary to deliver our services. These providers operate independently and maintain their own privacy and security standards. We do not sell personal information to third parties, and we do not disclose personal information for any other organisation’s marketing purposes.
7. Cross-Border Disclosure
Vistaprint and Snapfish may store or process images outside Australia. ShootProof, our gallery system, may also store your personal information (such as your name and email) outside Australia, as may some of our invoicing and website hosting providers. Where information is disclosed to an overseas recipient, we take reasonable steps to satisfy ourselves that they apply privacy and security standards comparable to those required under the Australian Privacy Principles.
8. Data Quality
We take reasonable steps to ensure the personal information we collect, use, and disclose is accurate, up to date, and complete. If any of your details change, please let us know so we can update our records.
9. Data Security
We store personal information and images on offline, password-protected and/or encrypted systems, and take reasonable steps to protect it from loss, misuse, interference, and unauthorised access, modification, or disclosure.
We retain personal information and images indefinitely, unless you ask us to delete them sooner. We do this so that you or your childcare centre can access reprints, replacement products, or past galleries at any time in the future.
No storage method can fully protect against events such as fire, theft, or hardware failure, and while we take reasonable precautions, we cannot guarantee against loss caused by such events or other matters outside our reasonable control.
10. Access and Correction
You can ask us for access to the personal information we hold about you or your child, or ask us to correct it, at any time. To make a request, contact us using the details below. We will respond within a reasonable timeframe. In some limited circumstances permitted by law, we may need to decline a request for access or correction, and if so, we will explain why.
11. Anonymity and Pseudonymity
Where it is lawful and practicable to do so, you may deal with us anonymously or using a pseudonym — for example, when making a general enquiry. However, we generally need your name and contact details to book and deliver a photography session or order. We do not discuss any order for a child, or any information about a child, unless you identify yourself as their guardian.
12. Government-Related Identifiers
We do not collect or use government-related identifiers (such as Medicare or driver’s licence numbers) as part of our standard photography or ordering process.
13. Complaints
If you have a concern about how we have handled your personal information, please contact us using the details below so we can investigate and try to resolve it. If you are not satisfied with our response, you can lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
14. Changes to This Policy
We may update this Privacy Policy from time to time. The most current version will always be available on both of our websites, follettphotography.com.au and earlylearningphotography.com.au.
